Construction director gets seven-year ban

A Southampton construction boss has been banned from being a company director for seven years.

Marian Daniel Clipici, sole director of Dahlial, failed to keep adequate accounts while his business was trading between 2017 and 2021 and was unable to explain the use of a pandemic Bounce Back loan.

Clipici’s construction business traded from the same address as the Dahlia Romanian restaurant, and he was also a director of a Romanian food shop.

Dahlial ceased trading in September 2021 and entered liquidation. Concerns raised by its liquidator led to an Insolvency Service investigation.

The Insolvency Service said accounts showed transactions of more than £1m, “none of which could be demonstrated to have been for legitimate company payments due to a lack of accounting records and documentation”.

Investigators found Clipici, aged 35, was unable to account for more than £530,000 paid into the business bank account, including the £40,000 Bounce Back loan paid in May 2020.

Businesses were only eligible for support through the Bounce Back Loan Scheme if the money was to be used to benefit the business.

Over the next four months Clipici withdrew £30,000, which he claimed was for payments to subcontractors and business expenses, but was unable to prove this.

Clipici was also unable to prove that the Bounce Back loan was validly obtained or used to support his business during the pandemic.

Liquidators found the company owed £60,396 to its bank and more than £7,000 to the tax authorities.

Clipici gave the Insolvency Service a disqualification undertaking after he did not dispute he had failed to ensure that Dahlial kept adequate accounting records.

This means that for seven years he cannot be involved in the promotion, formation or management of a company without court permission.

Lawrence Zussman, the service’s deputy head of insolvent investigation, said: “His disqualification should serve as a warning to other directors that if you do not take your responsibilities as a director seriously, you run the risk of being disqualified.”

In June, two construction bosses were banned from running businesses for 11 years after falsely applying for £100,000 of Bounce Back loans.
